Yesterday, the Supreme Court of Ireland finally gave their decision in the case of Brigid Delaney V Personal Injury Assessment Board, The Judicial Council, Ireland and the Attorney General.
In what was a very interesting decision, with several of the Supreme Court Judges giving various views on the legalities of the guidelines, it was decided that the Judicial Council’s Personal Injury Guidelines that replaced the previous Book of Quantum on the 24th of April 2021 are legally binding.
(Cases that have been brought from the 24th of April 2021, have all been subject to these guidelines)
The decision should, going forward, benefit consumers with lower premiums.
