Termination of Tenancy Agreement notice period has increased

Tenants and Landlords should be aware that as of the 6th July 2022 the notice periods a Landlord must provide to a Tenant on terminating their tenancy has increased.

The following is now the required notice periods:

  1. If the tenant has been residing at the property for less than six months – 90 days
  2. If the tenant has been residing at the property more than six months but less than one year – 152 days
  3. If the tenant has been residing at the property not less than one year but less than seven yeas – 180 days
  4. If the tenant has been residing at the property not less than seven years but less than eight years – 196 days
  5. If the tenant has been residing at the property not less than eight years – 224 days

Landlords and Tenants should both be aware that these do not apply when the Tenant has been served with a Notice of Termination for breach of Tenant’s obligations or for rent arrears.

Lastly, both parties should be aware that there is a new requirement that a Landlord must also send a copy of all Notice of Terminations to the Residential Tenants Board at the same time that they are serving a Notice of Termination on their Tenants.

The aforementioned time periods do not start until the Tenant and RTB have been served with a valid Notice of Termination.

It is imperative that all parties know their rights and responsibilities under the new legislation.
